The C Brand Digitals Terms of Service
By engaging with The C Brand Digitals, you acknowledge and agree to the following terms and conditions:

General Terms
When utilizing the services provided by The C Brand Digitals, you affirm that you are at least 18 years of age and possess the legal authority to enter into agreements on behalf of your organization. It is further understood that these services are not to be utilized for any illegal or unauthorized purposes, and you agree to comply with all laws and regulations applicable to your jurisdiction. In the event of a breach or violation of these terms, The C Brand Digitals reserves the right to terminate services immediately. The C Brand Digitals will not exceed 20 hours per week for marketing activities per client, unless otherwise agreed upon. Additionally, you acknowledge that The C Brand Digitals, including its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors, shall not be held liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of our services.

Professional Communication
The client agrees that any digital or print communications facilitated by The C Brand Digitals shall adhere to standards of professionalism and appropriateness. Examples of inappropriate messaging include but are not limited to:

Hate speech or discriminatory language

Profanity or vulgar language

Offensive or inflammatory content

Misrepresentation or false claims

Illegal activities or content

Harassment or bullying

Violation of intellectual property rights

Any other communication deemed unprofessional or inappropriate by The C Brand Digitals.
The client acknowledges and agrees to ensure that all communications adhere to these standards. The C Brand Digitals reserves the right to refuse or discontinue services if communications are found to violate these terms.

Payment
Payment for services rendered by The C Brand Digitals shall be processed through the website's designated payment portal, unless alternative arrangements have been agreed upon between The C Brand Digitals and the client. Clients are required to remit payment promptly upon receipt of invoices, which will be issued weekly for hourly services. Failure to submit payment within 5 days of the received invoice will result in the termination of services, unless otherwise agreed on. Services will not commence until payment is received, unless otherwise agreed upon. The C Brand Digitals reserves the right to add applicable taxes, fees, or surcharges to invoices as necessary. Any disputes regarding invoices must be raised within seven (7) days of receipt. Late payments may be subject to interest charges at a rate of 5% per month, compounded monthly, until the outstanding balance is settled. Clients are responsible for ensuring that their payment information on file is accurate and up-to-date. Any changes to payment information must be promptly communicated to The C Brand Digitals to avoid disruptions in service.

Privacy and Security
While The C Brand Digitals takes measures to protect the privacy and security of your information, we cannot guarantee complete protection against data breaches or mishandling of personal information by third-party services. The C Brand Digitals will protect your information to the best of our ability. It is understood that The C Brand Digitals shall not be held responsible for any such breaches or mishandling.

Social Media Management
The client is responsible for providing The C Brand Digitals with all necessary information, materials, and access to social media accounts required to perform the agreed-upon services. This includes providing appropriate login credentials for social media platforms. Clients are responsible for covering any ad costs associated with their campaigns and may specify which social media platforms are to be accessed for service purposes. The C Brand Digitals will make every effort to securely store and protect any login information provided by the client. This information will be kept confidential and used solely for the purpose of providing the agreed-upon services. The C Brand Digitals reserves the right to terminate services if the client fails to provide necessary information or access to social media accounts, or if there is a breach of the terms outlined in this agreement.
The C Brand Digitals will abide by the community guidelines and terms of service of each social media platform used for marketing and management activities.

Website Services
The Client agrees to provide all necessary materials and information required for the website design project, including but not limited to logos, images, content, and any specific design preferences. The Client agrees to provide the appropriate login information (e.g., hosting account, CMS login) to grant The C Brand Digitals access to the website for design and management purposes. The Client acknowledges that the security of this login information will be maintained to the best of The C Brand Digitals' ability. The C Brand Digitals agrees to use the provided login information solely for the purpose of completing the website design project. The C Brand Digitals agrees to maintain the confidentiality and security of the provided login information to the best of their ability, taking reasonable measures to prevent unauthorized access or disclosure. Clients utilizing website services provided by The C Brand Digitals understand that security and privacy protections are provided by the website hosting service, and as such, The C Brand Digitals shall not be held responsible for any data leaks.
Upon completion of the website design project and full payment of all fees, the Client shall own the rights to the completed website design, excluding any third-party elements such as stock images or licensed software. The C Brand Digitals retains the right to display the completed website design in their portfolio and marketing materials, unless otherwise agreed upon with the Client.
The Designer shall not be liable for any damages arising from the use or inability to use the website design, including but not limited to lost profits, loss of data, or business interruption. The Client agrees to indemnify and hold harmless The C Brand Digitals from any claims, damages, or expenses arising from the use of the website design.

Branding
Clients must disclose whether any works produced by The C Brand Digitals will be trademarked or copyrighted at the onset of service. The C Brand Digitals shall not be held liable for any legal actions taken against logos that infringe upon trademark, copyright, or other laws not specified in this agreement.

Graphic Design
Content creation undertaken by The C Brand Digitals utilizes third-party apps and tools, with data and privacy protection subject to the terms and conditions of the third-party service provider. The C Brand Digitals shall not be held liable for any subsequent legal actions taken.

Hourly Service Agreement
Clients engaging The C Brand Digitals on an hourly basis for various services must adhere to the following terms:
1. Hourly Wage and Billing: Clients are required to pay The C Brand Digitals an hourly wage as mutually agreed upon. Invoices for the hours spent on the client's service will be issued weekly. Failure to settle the previous week's invoice will result in the termination of services.
2. Pay Schedule: Pay schedules can be discussed and adjusted per client based on mutual agreement. Clients have the flexibility to modify pay schedules to suit their needs.
3. Service Scope: This arrangement allows clients to enlist The C Brand Digitals for a range of services on an as-needed basis.

Service Limitations
The total hours devoted to marketing services for a single client per week shall not exceed 20 hours, unless otherwise agreed upon.
By engaging The C Brand Digitals under these hourly service terms, clients acknowledge and agree to abide by the terms outlined herein.

Client Protections
Any legal actions taken against The C Brand Digitals regarding services provided are subject to the provisions outlined in this agreement.
Any revisions to these terms will be posted on The C Brand Digitals’ website (www.thecbranddigitals.com). In the event that the Terms of Service are updated subsequent to the signing of this document, you will be notified via email of the revised terms. You will then have 7 calendar days to respond to the updated Terms of Service. If there are no objections to the updated terms, services will continue as usual. If you disagree to said terms, services will be suspended immediately, with no guarantee of refunds.
Acknowledgment of Terms
By continuing with service, you acknowledge that you have read, understood, and agree to the terms and conditions outlined in this Service Agreement and Acknowledgement of Terms.
